Data Protection Act
Since 1st March 2000 CCTV systems have been required to comply with the Data Protection Act. This doesn’t mean that every single CCTV system must comply in all respects to all the restrictions and indeed many systems are exempt from all the restrictions of the DPA. However anyone installing or using a CCTV system should be aware of the DPA and operate within it’s requirements
In general exemptions to the DPA will include:
- Limited systems installed in private households for domestic security purposes.
- The use of cameras for recreational purposes.
- The use of broadcast media camera for journalism, although passing CCTV images to the media will apply.
- Covert surveillance by the Law Enforcement Authorities.
- Non-operational systems (dummy cameras).
The Information Commissioner’s Office ‘CCTV Code of Practice’ should be read by anyone thinking of installing CCTV or using an existing system.
